2. DATA CONTROLLER, DATA PROTECTION OFFICER, AND REPRESENTATIVE

Sole Dynamix is the data controller of the Personal Data (as defined by the EU General Data Protection Regulation (“GDPR”) or its successor) you provide through the Services.

At this time, Sole Dynamix is not required to appoint a Data Protection Officer or a representative in the EU, and has elected not to do so. Sole Dynamix may be contacted in any manner set forth below in the “CONTACT US” Section of this Privacy Policy.

3. COLLECTION OF PERSONAL INFORMATION

To better provide you with products and Services offered, Sole Dynamix may collect personally identifiable information, Sole Dynamix collects the following categories of personal information, including in the preceding twelve months. This information is collected when you provide it directly to us and when you use the Services. This information includes both personally identifiable information and information which does not directly identify you.

Browsing Information. When you visit our website, we collect browsing information, such as your IP address, browser type, browser settings, device ID, operating system, and cookie ID.

Comment and Opinion Information. When you interact with chat features, our social media pages, or contact us, we may collect comment and opinion information. Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through Sole Dynamix public message boards or social media pages, this information may be collected and used by others. 

Commercial Information. When you become a vendor or customer, we may collect information such as your business address or business phone number.

Contact Information. In order to better provide you with products and Services offered, Sole Dynamix may collect personally identifiable information, such as your first and last name, mailing address, e-mail address, and phone number.   

Financial Information. If you purchase Sole Dynamix products and Services, we collect billing and credit card information. This information is used to complete the purchase transaction. 

Sensory and Electronic Information. If you visit one of our physical locations, we may collect sensory and electronic information, such as through CCTV recordings.

Social Media Information. When you interact with our social media pages, we may collect information, including your username, first and last name, contact information, profile picture, and post history.

User Account Information. If you create an account with us, we may collect your account username and account password.

Biometric data. In certain circumstances, such as when you voluntarily use our Application, we may collect information for the purpose of creating a 3D model of your feet in order to create custom orthotics.

Non-personally identifiable, aggregated information. We may collect aggregated information, such as Website usage data. This data is collected in the aggregate only but may include or be combined with other user information that users have voluntarily submitted.

When do we collect personal information?

We collect this information when you take certain actions, such as:

• Entering a sweepstakes or contest sponsored by us or one of our partners

How long do we keep personal information?

• Please understand that residual copies of the personal information can be stored in locations or formats that make complete erasure extremely difficult.
• The best way to ensure you control your information is to give us only the personal information that you are completely comfortable sharing with us.

Sensitive Information. Generally, Sole Dynamix does not collect, use, process, sell, or share personal information which is classified as sensitive information. However, when you consent to use our Application, we may collect biometric data regarding the dimensions of your feet so that we may design custom orthotics.

Sole Dynamix may share data with trusted partners to help us provide the Services or perform business functions on our behalf. Sole Dynamix’s process to fulfil a privacy rights request:

First, we acknowledge your request.

• Sole Dynamix will first send you a message acknowledging receipt of your request within 10 days.

Next, we ensure that you are the person making the request.

• In general, when you make a request Sole Dynamix will take steps to verify your identity.
• Verification steps may include asking you for personal information, such as your name, address, or other information we maintain about you or your child.
• If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to the request. In that case, we will notify you to explain the basis of the denial.

Finally, we provide a response.

• We will either honor your request or tell you why we denied it.

Your agent can submit requests for you.

• You may also designate an authorized agent to submit requests on your behalf.
• If you do so, you will be required to verify your identity by providing us with certain personal information as described above.
• Additionally, we will also require written proof the agent has permission to act on your behalf.

How long will it take?

• Sole Dynamix will either fulfill or reject your request as soon as we can, generally within 45 days from when we receive your request (or less, if required by law).
• But we may be allowed to take longer to process your request under certain circumstances.
• We will let you know if we expect your request will take us longer than normal to fulfill.

What if my request is denied?

• You may appeal your denial if you feel we have made a mistake.
• To submit an appeal please use the same method of contact listed above.
• If you are still not satisfied with our response then, under certain circumstances, you may contact your state privacy enforcement agency.

9. YOUR PRIVACY CHOICES 

Messaging and newsletter communications.

• You may control how you receive certain types of communications by unsubscribing within the body of the communication.
• Note that some messages are required, service-related messages like transaction confirmation messages, legal notices, or updates.

The Sole Dynamix Website may use cookies and other embedded tracking technology which automatically collect users’ browsing information when they use our Website. Cookies help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you. 

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalized Sole Dynamix pages, or register with Sole Dynamix Website or Services, a cookie helps Sole Dynamix to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same Sole Dynamix website, the information you previously provided can be retrieved, so you can easily use the Sole Dynamix features that you customized.

Opt out of cross-site and interest-based advertising.

First, this is not a universal opt out request you submit to us.

• Submitting a request to opt out of cross-site advertising using the methods below is not the same as opting out of the way we use your personal information.
• Sole Dynamix does not receive your opt out of cross-site advertising.
• For more details on limiting how we use your information, see the section above regarding Your Privacy Rights.

What happens when I opt out of cross-site advertising?

• When you opt out, your selection is stored on a cookie on your device.
• If you delete the cookie from that device or sign in from a different device, you will need to opt out again.

Does opting out of cross-site advertising stop all data collection?

• Because the data used for interest-based advertising is also used for other necessary purposes (including providing our Services, for authentication, and security purposes), opting out of interest-based advertising does not stop the data from being collected nor reduce the number of advertisements you will see.
• However, the data will not be used for interest-based advertising, which means the advertisements you do see may be less relevant to you.
